Terms of Service

“Zily” is the product and trading name for the property research service at zily.app. Your contract is with the seller identified in the Whop checkout, order confirmation, or invoice (the “Operator”, “Zily”, “we”, “us”, or “our”). That seller record forms part of these Terms and supplies the applicable legal entity, address, and licensing details.

If the seller is not clearly identified before payment, do not complete the purchase and contact [email protected]. Whop separately provides the payment marketplace under its own terms.

• You must be at least 18 years old and legally able to enter a binding contract.
• You must provide accurate account information, keep credentials secure, and promptly update material changes.
• One account is for one person or the organization expressly subscribed. You may not sell, share, or transfer access without written permission.
• You are responsible for activity through your account unless you promptly notify us of suspected unauthorized access.

Zily is a research and analysis service for the Dubai property market. Features may include listing discovery, price comparisons, area comparisons, saved deals, alerts, investment calculations, and API access where included in your plan.

Zily does not provide listing discovery, benchmarks, or deal scoring for other emirates. Available Dubai coverage can remain empty or incomplete. The calculators use Dubai assumptions and must not be applied to another emirate without independent verification.

Listing information may originate from third-party portals, public records, authorized feeds, brokers, or other attributed sources. Sources can change or remove records without notice. Zily may normalize and compare records, but does not own or independently certify every underlying claim.

• Discounts and distress scores are analytical signals, not valuations or guarantees that a seller is distressed.
• Benchmarks may be delayed, incomplete, or unsuitable for a specific building, tenure, unit condition, or transaction.
• Calculator results depend on your inputs and stated assumptions.
• You must verify availability, title, ownership rights, price, condition, service charges, financing, and official fees before relying on a record.

Free access is limited as shown on the pricing page. Pro and Premium are recurring monthly memberships processed by Whop. The price, billing period, currency, applicable tax, and payment method shown at checkout control your purchase. Current web pricing is USD 29 per month for Pro and USD 150 per month for Premium.

• Your paid membership renews automatically until cancelled.
• You authorize Whop and its payment providers to charge the displayed amount at each renewal.
• You can cancel through the Zily billing page or Whop. Cancellation stops future renewal; access ordinarily continues through the paid period.
• Plan changes take effect only after Zily verifies the provider membership. Access is never inferred solely from a return URL.
• Refunds are governed by the Cancellation & Refund Policy and any mandatory consumer rights.

You may use Zily for lawful internal research and decision support. You must not:

• scrape, crawl, bulk-export, mirror, resell, republish, or build a competing dataset from the service except through an expressly permitted API plan;
• bypass rate limits, access controls, plan restrictions, robots rules, or source attribution;
• probe security, introduce malware, automate abusive traffic, or disrupt the service;
• use listing or contact data for spam, harassment, discrimination, unlawful profiling, or unsolicited mass marketing;
• misrepresent Zily output as an official valuation, guaranteed return, legal opinion, or verified seller motivation;
• violate a source’s rights, terms, applicable UAE law, export controls, sanctions, or another person’s privacy or intellectual-property rights.

You retain ownership of notes, alert criteria, and other material you submit. You grant Zily a limited, worldwide license to host, copy, process, and display that content only as needed to provide, secure, and support the service. Do not enter confidential third-party data or sensitive personal information into notes.

Feedback may be used to improve Zily without payment or restriction, provided we do not publicly identify you without permission.

Zily’s software, interface, branding, scoring presentation, documentation, and original content are protected by applicable intellectual-property laws. Subject to these Terms and your plan, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service for your own lawful internal purposes. No ownership transfers to you.

Third-party listing text, images, marks, and data remain the property of their respective owners and are subject to source terms.

Zily depends on services such as Clerk for authentication, Whop for billing, Resend for email, Cloudflare for delivery and security, database infrastructure, and attributed property sources. Their terms and privacy notices apply to their independent services. Zily is not responsible for a third-party website’s content, availability, or transaction.

Engage appropriately licensed professionals and verify records with the relevant land department, municipality, developer, owners’ association, lender, and other authorities before signing or transferring funds.

We aim to provide a reliable service but do not promise uninterrupted access or a minimum number of listings. A legitimate result may be an empty feed. Sources, benchmarks, plan limits, and features may change as availability, law, source permissions, or product safety require. Material adverse changes to a paid plan will be communicated as required by law.

You may stop using Zily or cancel renewal at any time. We may restrict or terminate access for material breach, fraud, payment failure, security risk, unlawful conduct, source-rights violations, or where continued service would expose users or Zily to harm. Where reasonable, we will provide notice and an opportunity to correct a curable issue.

To the maximum extent permitted by law, Zily is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that a listing is current, below fair value, legally transferable, financeable, or suitable for you.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

To the maximum extent permitted by law, Zily and the Operator are not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages; missed property opportunities; investment loss; financing costs; or decisions made from third-party data or user-supplied assumptions.

For claims that may lawfully be limited, aggregate liability will not exceed the fees you paid for Zily during the three months immediately before the event giving rise to the claim. This limit does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or liability that applicable law does not permit us to limit.

These Terms are governed by the laws identified in the seller information attached to your checkout. Where that record does not specify governing law, UAE federal law applies, without prejudice to mandatory rights available in your place of residence. Courts of competent jurisdiction in the UAE have non-exclusive jurisdiction unless mandatory law requires another forum.

Before filing a claim, please send a written description to [email protected] and allow 30 days for a good-faith resolution attempt. This does not prevent urgent injunctive relief or use of a consumer authority or Whop’s Resolution Center.

We may update these Terms for legal, security, source, billing, or product changes. We will update the effective date and provide additional notice where required. Material changes apply prospectively. If one provision is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver.
